Family of asbestos disease victim files asbestos mesothelioma lawsuit in Texas

The family of a Texas man who died from a combination of lung cancer and pulmonary asbestosis has filed a lawsuit against Chevron, arguing that the company is to blame for the man’s death, and was wrongfully caused. The surviving family of Jesse Foreman, which includes his wife Clara and his sons Vergie, Darrell, and Darnell Foreman, argues that the late Mr. Foreman was never told of the health risks associated with asbestos exposure.

Mr. Foreman passed away after battling the deadly combination of diseases on March 21, 2008, according to a lawsuit filed earlier this month in Jefferson County District Court.

Throughout his career, Foreman worked various jobs, including a pipefitter helper, insulator trainer and instrument mechanic. During the course of his work, Jesse Foreman was exposed to and inhaled or ingested asbestos fibers. Asbestos exposure is conclusively linked to the development of mesothelioma, a rare form of cancer, as well as asbestosis, pleural plaques, and other respiratory ailments. Mesothelioma affects less than 3,000 Americans each year, and while there are palliative treatment methods available, including chemo, there is no known cure. The majority of patients lose their battle with this cancer in less than two years following diagnosis.

The plaintiffs say that Chevron failed to warn Foreman of the dangers of asbestos exposure, and also failed to take “necessary precautions” to protect him from asbestos-containing products. The plaintiffs are seeking punitive and exemplary damages, plus court costs, and other monetary compensation that the court deems fit.
