Breach of Warranty - In mesothelioma cases, the term breach of warranty most often refers to the lack of veracity of any statement which attests to the assurance of quality of an item or product sold. For example, a company that manufactures asbestos products may attest to the safety of their products while the opposite is true. That constitutes a Breach of Warranty. The party making the warranty is liable to the party to which it is made. In modern courts of law, the warranty does not need to be formally stated in writing but may be implied at the time of use.
